Owning Dubai property as a Hungarian resident: what is taxed in the UAE, and what at home?

"Dubai has no tax" is only half the story. We summarise what UAE rules say, what the Hungary–UAE treaty says, and which questions are worth settling with a tax adviser.

One of the questions we hear most from Hungarian buyers is this: if Dubai has no personal income tax, is the rent really tax-free? The short answer: in the UAE, for an individual, usually yes, and in Hungary the treaty between the two countries determines what happens to it. The longer answer depends on how you hold and use the property, and where you are tax resident.

This article is a general overview to help you ask the right questions. It is written for Hungarian tax residents; if you live elsewhere, your own country's treaty with the UAE will apply instead. It does not replace personal tax advice, especially for company ownership, business-scale short-term letting or relocation.

In short: what is taxed where?

Situation UAE Hungary (resident individual)
Long-term rental income, held personally No personal income tax Exempt under the treaty, though reporting duties may apply
Gain on selling the property No capital gains tax Exempt under the treaty
Short-term letting with a permit Usually no income tax; VAT above a turnover threshold Needs individual review
Ownership through a company A corporate tax question Needs individual review
Purchase 4% DLD fee (a fee, not a tax) No Hungarian duty on buying abroad
0%personal income tax in the UAE
15%Hungarian personal income tax rate, 2026

AED 1Mcorporate tax threshold for an individual's business turnover

The UAE side: no income tax, with a few exceptions

The UAE levies no personal income tax, and there is no capital gains tax or annual property tax. A federal corporate tax has existed since 2023, but it reaches individuals only in narrow cases.

Under Cabinet Decision No. 49 of 2023, an individual is subject to corporate tax only if they carry on a licensed business activity with annual turnover above AED 1 million. Real estate investment, meaning selling, leasing or sub-leasing your own property where no commercial licence is required, does not count as such an activity. Rent from an apartment you hold personally and let long term is therefore outside corporate tax.

VAT. Long-term leasing of residential property in the UAE is generally VAT-exempt. For short-term holiday letting, however, VAT registration becomes mandatory once 12-month turnover exceeds AED 375,000. Operators usually handle this, but responsibility should be settled in the management agreement.

Fees, not taxes. The 4% DLD fee, service charges and the municipal charges on the DEWA bill are not taxes, but they are costs in any yield calculation. Our cost guide covers them in detail.

The Hungarian side: residence is the starting point

In Hungary, a resident individual is in principle taxed on worldwide income, at a flat 15% personal income tax. Under the Hungarian personal income tax act, a Hungarian citizen is resident by default. The exception is a dual citizen with no permanent or habitual place of residence in Hungary.

Where someone is resident under the rules of both countries, the treaty's tie-breaker rules decide which takes precedence: where the person has a permanent home, where their vital interests lie, where they habitually stay. Buying a Dubai apartment, or obtaining a Golden Visa, does not change this by itself.

What the Hungary–UAE treaty says

The two countries signed their double taxation agreement in Dubai on 30 April 2013. Hungary enacted it by Act CLXI of 2013, and it entered into force on 4 October 2014.

The key provisions for property:

  • Article 7: income from immovable property, such as rent, may be taxed in the state where the property is located, the UAE.
  • Article 14: gains from selling immovable property may likewise be taxed in the state where it is located.
  • Article 23: Hungary uses the exemption method. It exempts income that may be taxed in the other state, but may take it into account when calculating tax on other income (exemption with progression).

The treaty therefore gives the taxing right to the UAE, and Hungary exempts the income. Because Hungarian personal income tax is a flat rate, progression has little practical effect.

In practice: three typical situations

1. Long-term letting, held personally. Rent of, say, AED 80,000 a year on a JVC apartment is not taxed in the UAE and, under the treaty, is in principle exempt in Hungary. Keep the lease, its Ejari registration, the rent receipts and your costs well organised, since they let you document the source and nature of the income.

2. Selling at a gain. If you sell an apartment bought for AED 1.1 million at AED 1.3 million, the UAE levies no capital gains tax, and in Hungary the gain is in principle exempt under Articles 14 and 23 of the treaty. Again, keep the purchase and sale documents and related fees.

3. Short-term letting. For a permitted unit held personally, the UAE income tax position is usually the same, but VAT and tourism fees make it more complex. On the Hungarian side it is especially important to check that the activity is not treated as a different category of income.

Company ownership is a different world

If you buy through a UAE, Hungarian or other company, very different rules may apply: corporate tax, controlled foreign company rules, dividend taxation. Only set up such a structure with a tax adviser.

Golden Visa, relocation and residence

A Golden Visa is a residence permit, not tax residence. Under UAE rules an individual is generally tax resident there after spending at least 183 days in the country in a 12-month period, or at least 90 days if they also hold a UAE residence permit and have a permanent home or employment there. If your family, home and work remain in Hungary, your Hungarian residence will usually continue. We cover the visa in the Dubai Golden Visa through property.

If you really are planning to move, plan it with a tax adviser well in advance, because a change of residence has many consequences.

Transparency and record-keeping

The UAE takes part in the international automatic exchange of financial account information (CRS). That means data on a UAE bank account can reach the Hungarian tax authority. This is not a problem if everything is in order, but it is worth running your Dubai investment so that you can document at any time:

  • the source of the money used for the purchase;
  • the sale and purchase agreement, title deed and DLD fee payments;
  • leases and rent received;
  • sale documents, if you sell.

Questions worth asking your tax adviser

  • Am I Hungarian tax resident, and could that change if I spend more time in Dubai?
  • How should Dubai rental income and any sale gain be handled in my Hungarian return?
  • Does social contribution tax or any other contribution apply?
  • Is short-term letting through an operator treated differently from an annual lease?
  • What changes if I buy jointly with my spouse, or through a company?
  • Which documents should I keep, and for how long?

Inheritance: think about a will

The UAE has no inheritance tax, but succession is not straightforward for a foreign owner. Non-Muslim foreigners can register a will in Dubai, for example with the DIFC wills registry, the Dubai courts or a notary. A will made at home can also cover UAE assets, but having it recognised involves a longer, multi-step legalisation process. If you own significant property in Dubai, a will matters at least as much as tax planning.

Frequently asked questions

Do I pay Hungarian tax on Dubai rent?

As a Hungarian resident individual letting a personally held apartment long term, the treaty has Hungary exempt this income. Check reporting duties and details with a tax adviser.

Is it taxable when I transfer the rent home?

Transferring money home is not a taxable event in itself. What matters is the income it comes from and how that is taxed. The bank transfer also serves as good documentation.

Does a Golden Visa change my Hungarian tax position?

Not by itself. The Golden Visa is a residence permit. Your tax residence depends on where you actually live and where your home and vital interests are.

Should I set up a company to buy in Dubai?

For one or two apartments, personal ownership is usually simpler and more transparent. A company structure may come up with a larger portfolio or business-scale letting, but only after careful tax planning.

Is it a problem to keep the rent in a UAE bank account?

No, but bear in mind that the UAE takes part in the automatic exchange of financial account information, so account details can reach the Hungarian tax authority. What matters is that the origin and tax position of the money in the account can be documented.
